By accessing, browsing, or using our website, or by placing an order for any products or services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you are not authorized to use our Services. These Terms apply to all visitors, users, customers, and others who access our website or purchase our products and services.

These Terms may be amended, modified, or supplemented by us from time to time. We will provide notice of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any updates or changes.

Additional terms may apply to specific services, products, or promotions. In the event of a conflict between these Terms and any additional terms, the additional terms shall prevail with respect to the specific service or product to which they apply.

MarsHub provides a comprehensive suite of cryptocurrency mining solutions and related services designed to meet the needs of individual miners, mining operations, and institutional investors worldwide.

ASIC Miner Sales: We offer an extensive catalog of application-specific integrated circuit (ASIC) miners from the world's leading manufacturers, including:

• Bitmain: Antminer series including S21, S19, and T21 models
• MicroBT (WhatsMiner): M50, M30, and M60 series
• Canaan: AvalonMade series and newer generations
• Other manufacturers: Innosilicon, Goldshell, and emerging brands

Mining Farm Hosting Services: Our professional hosting solutions provide colocation for your mining equipment in purpose-built data centers with:

• Competitive electricity rates: USD 0.04 to USD 0.06 per kWh
• Professional facility management and 24/7 monitoring
• High-speed internet connectivity with redundant network providers
• Climate-controlled environments optimized for ASIC operation (15-25°C)
• Security measures including video surveillance and access control

Market Data API: We provide real-time cryptocurrency mining profitability data, hashrate statistics, and market intelligence to help you make informed decisions about your mining operations. This service is provided for informational purposes only and does not constitute financial advice.

By placing an order with MarsHub, you agree to the following terms regarding pricing, payment, and order processing:

Pricing:

• All prices are denominated in United States Dollars (USD) unless otherwise specified
• Prices are subject to change without prior notice due to market conditions, currency fluctuations, and manufacturer pricing adjustments
• Quoted prices are valid for the duration indicated in your quote; expired quotes require re-confirmation
• Bulk orders may qualify for volume discounts; contact our sales team for custom pricing

Payment Terms:

• We accept wire transfer (SWIFT/TT), cryptocurrency payments (BTC, ETH, USDT), and selected fiat currencies through approved payment processors
• Payment must be received and cleared before order processing begins
• Cryptocurrency payments are subject to blockchain confirmation requirements
• Wire transfer fees are the responsibility of the buyer

Taxes and Duties:

• All applicable taxes, including value-added tax (VAT), goods and services tax (GST), and sales tax, are the responsibility of the buyer unless otherwise stated
• Import duties, customs fees, and clearance charges for international shipments are the buyer's responsibility
• Buyers are responsible for ensuring compliance with import regulations in their country

Refund Policy:

• ASIC Miners: 30-day refund period from date of receipt for undamaged, unopened units in original packaging. Mining equipment that has been powered on or configured is not eligible for refund. A 15% restocking fee applies to approved returns.
• Hosting Services: 7-day money-back guarantee for new hosting clients. After 7 days, hosting fees are non-refundable for the current billing period. Monthly hosting fees are billed in advance.
• Refunds are processed within 14 business days of receiving returned merchandise

MarsHub offers worldwide shipping through established logistics partners to ensure safe and timely delivery of your mining equipment.

Shipping Carriers:

• DHL Express: Primary carrier for time-sensitive international shipments with comprehensive tracking and insurance options
• FedEx International Priority: Alternative premium shipping service with worldwide coverage and customs clearance support
• Freight Services: For bulk orders and equipment pallets, we arrange specialized freight forwarding with customs brokerage

Delivery Timeframes:

• Standard lead time: 7 to 15 business days from order confirmation and payment clearance
• Express shipping options available for additional charge with reduced delivery times
• Lead times may be extended during periods of high demand or supply chain disruptions
• Pre-order items have estimated availability dates; actual shipment dates may vary

Shipping Costs:

• Shipping costs are calculated based on weight, dimensions, destination, and shipping method selected
• Insurance is strongly recommended for all shipments; MarsHub offers optional shipping insurance
• Buyers are responsible for all shipping, handling, and insurance charges

Customs and Import Duties:

• International shipments require customs declaration; accurate HS codes are provided for all products
• Customs duties, import taxes, and clearance fees are the sole responsibility of the recipient
• Delays caused by customs clearance are not the responsibility of MarsHub
• Buyers should verify import eligibility for cryptocurrency mining equipment in their jurisdiction

Delivery Verification: Upon delivery, buyers must inspect all packages for visible damage before signing delivery confirmation. Any damages or discrepancies must be reported to MarsHub within 48 hours of delivery.

By enrolling in MarsHub's mining farm hosting services, you agree to the following terms governing the custody, operation, and management of your mining equipment:

Miner Custody and Care:

• Your ASIC miners will be physically housed in our secure data center facilities in Indonesia, the United States, and other locations
• Facility security includes 24/7 monitoring, restricted access, fire suppression systems, and climate control
• MarsHub is responsible for proper housing and maintenance of your equipment under normal operating conditions
• Equipment remains your property; MarsHub does not claim ownership of customer-hosted miners

Mining Pool Configuration:

• The default mining pool is F2Pool; alternative pools may be configured upon customer request
• Payout thresholds, fee structures, and payout schedules are determined by the selected mining pool
• MarsHub is not responsible for mining pool performance, fees, or payout delays
• Wallet addresses must be provided by the customer for mining reward collection

Hosting Fees and Billing:

• Hosting fees are billed monthly in arrears based on actual electricity consumption
• Electricity rates range from USD 0.04 to USD 0.06 per kWh depending on facility location and contract terms
• Minimum hosting term: 6 months; early termination fees may apply
• Payment methods for hosting fees: wire transfer, cryptocurrency, or approved payment processor

Uptime and Service Level:

• MarsHub guarantees a 99% uptime SLA for hosted miners under normal operating conditions
• Downtime resulting from scheduled maintenance will be communicated in advance
• Downtime due to customer equipment failure, power outages beyond our control, or force majeure events is excluded from SLA calculations
• For every 1% below the 99% threshold, customers receive a credit proportional to affected hosting days

MarsHub stands behind the quality of our products and offers comprehensive warranty coverage for mining equipment purchases.

Hardware Warranty:

• 365-day limited warranty from date of purchase covering manufacturing defects and hardware failures under normal use
• Warranty coverage includes ASIC chips, hash boards, control boards, and power supplies
• Warranty does not cover damage from improper installation, overclocking, power surges, physical damage, or unauthorized modifications
• Proof of purchase is required for all warranty claims
• Manufacturer warranties (where applicable) are passed through to the customer

Return Merchandise Authorization (RMA) Process:

• All warranty returns require prior RMA authorization from MarsHub customer support
• To initiate an RMA: contact support via email (Sales@marshub.shop), WhatsApp (+86 19176611580), or Telegram (@marshub)
• Standard RMA turnaround time: 30 business days from receipt of defective equipment
• Customer is responsible for shipping costs to return equipment; MarsHub covers return shipping for verified warranty claims
• Repaired or replacement units will be shipped at MarsHub's expense via standard shipping method

Dead on Arrival (DOA) Policy:

• Units that arrive non-functional due to shipping damage or manufacturing defects qualify for immediate replacement
• DOA claims must be reported within 48 hours of delivery with photographic evidence
• DOA units will be replaced with new or refurbished units of equivalent specifications
• Express shipping of replacement units available for urgent cases

Limitation of Warranty: The warranty provided by MarsHub is exclusive and in lieu of all other warranties, express or implied, including any warranties of merchantability or fitness for a particular purpose. MarsHub's liability for warranty claims shall not exceed the original purchase price of the product.

As a user of MarsHub's services, you accept certain responsibilities and obligations regarding your account, information accuracy, and lawful use of our platform.

Account Registration and Accuracy:

• You must provide accurate, current, and complete information during registration and maintain its accuracy
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify MarsHub immediately of any unauthorized access or security breach
• You may not share your account with others; each user must maintain their own account

Lawful Use:

• You agree to use MarsHub's services only for lawful purposes and in compliance with all applicable laws and regulations
• Cryptocurrency mining and ownership must be legal in your jurisdiction; you are responsible for verifying your local regulations
• You may not use our services for any illegal activities, including but not limited to money laundering, fraud, or terrorist financing
• You may not attempt to gain unauthorized access to MarsHub systems, other customer accounts, or any related infrastructure

Prohibited Jurisdictions:

• MarsHub does not provide services to individuals or entities in sanctioned jurisdictions as designated by the United Nations, United States (OFAC), European Union, or other applicable authorities
• You represent and warrant that you are not a citizen or resident of, nor located in, any country subject to comprehensive sanctions
• MarsHub reserves the right to terminate services to users in restricted jurisdictions

Know Your Customer (KYC):

• KYC verification is required for all orders exceeding USD 50,000
• Required KYC documents may include government-issued identification, proof of address, and source of funds documentation
• MarsHub may conduct enhanced due diligence for high-value transactions or unusual patterns
• Failure to provide required KYC documentation may result in order cancellation or account suspension

Prohibited Conduct: You may not abuse, defame, harass, or harm other users; interfere with or disrupt our services; or engage in any activity that damages MarsHub's reputation or business operations.

MarsHub respects intellectual property rights and expects our users to do the same. This section outlines the ownership and usage terms for content and trademarks associated with our platform.

MarsHub Trademarks:

• "MarsHub™" and associated logos, slogans, and brand identifiers are trademarks of MarsHub Trading Co., Limited
• Unauthorized use of MarsHub trademarks is strictly prohibited
• Limited license to use MarsHub trademarks is granted solely for the purpose of identifying MarsHub as the source of products or services
• Any use of MarsHub trademarks in a manner that damages our brand reputation will result in immediate termination of your rights

Website Content Ownership:

• All content on the MarsHub website, including text, graphics, logos, images, software, and design elements, is the property of MarsHub or its content suppliers
• Content is protected by copyright, trademark, and other intellectual property laws
• Reproduction, distribution, modification, or republication of website content without prior written consent is prohibited
• Product images and specifications are used with permission from respective manufacturers

Third-Party Content:

• Third-party trademarks, product names, and specifications belong to their respective owners
• MarsHub acknowledges the proprietary rights of Bitmain, MicroBT, Canaan, and other manufacturers
• Market data, pricing information, and hashrate statistics are provided for informational purposes

DMCA Compliance:

• MarsHub responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act
• To report copyright infringement, provide the required information to: Sales@marshub.shop
• Repeat infringers will have their accounts terminated upon receipt of valid DMCA takedown requests

User-Generated Content: Users retain ownership of content they submit to MarsHub but grant us a worldwide, royalty-free license to use, reproduce, and display such content for operating and improving our services.

To the maximum extent permitted by applicable law, MarsHub and its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.

No Guarantee of Mining Rewards:

• MarsHub does not guarantee any specific level of mining rewards or profitability
• Cryptocurrency mining returns are influenced by market conditions, network difficulty, electricity costs, and other factors beyond our control
• Past performance of mining equipment does not indicate future results
• MarsHub is not responsible for fluctuations in cryptocurrency prices, network hashrate, or mining difficulty

Market Volatility Risk:

• The value of cryptocurrency assets can fluctuate dramatically in short periods
• Users bear full responsibility for market risk associated with cryptocurrency holdings and mining operations
• MarsHub is not liable for losses resulting from adverse market conditions
• Users should consult qualified financial advisors before making investment decisions

Maximum Liability:

• MarsHub's total cumulative liability for any claims arising from or related to these Terms shall not exceed the total amount paid by the customer for the specific order or service giving rise to the claim
• This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise
• The foregoing limitation does not apply to damages arising from death or personal injury caused by MarsHub's negligence

Force Majeure: MarsHub shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic events, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Indemnification: You agree to indemnify and hold harmless MarsHub from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your illegal activities.

These Terms shall be governed by and construed in accordance with the laws specified below, without regard to conflict of law principles.

Governing Law:

• These Terms are governed by the laws of the Hong Kong Special Administrative Region (Hong Kong SAR)
• The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms
• Hong Kong law applies to all disputes regardless of the user's location

Dispute Resolution Process:

• Step 1 - Direct Resolution: In the event of a dispute, users should first contact MarsHub customer support to attempt informal resolution
• Step 2 - Mediation: If direct resolution fails within 30 days, either party may request mediation through a mutually agreed-upon mediation service
• Step 3 - Arbitration: Any dispute not resolved through mediation shall be finally settled by International Chamber of Commerce (ICC) arbitration
• ICC arbitration proceedings shall be conducted in Hong Kong under ICC Rules of Arbitration
• The arbitration shall be conducted in the English language
• The arbitration award is final and binding on both parties

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Limitation Period: Any claim or cause of action arising out of or related to these Terms must be filed within one (1) year from the date the cause of action arose, or such claim shall be forever barred.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with any additional terms, privacy policy, and guidelines referenced herein, constitute the entire agreement between you and MarsHub concerning your use of our services and supersede all prior agreements and understandings.
